যে কর্মকর্তা, সৈনিক, নাবিক বা বিমানসেনা ছুটি পান না, তিনি তাঁর পক্ষে মোকদ্দমা করতে বা আত্মপক্ষ সমর্থন করতে যে কোনো ব্যক্তিকে ক্ষমতা দিতে পারবেনঅনানুষ্ঠানিক অনুবাদ
(1) Where any officer, soldier, sailor or airman actually in the service of the ²[Republic] in such capacity is a party to a suit, and cannot obtain leave of absence for the purpose of prosecuting or defending the suit in person, he may authorise any person to sue or defend in his stead.
(2) The authority shall be in writing and shall be signed by the officer, soldier, sailor or airman in the presence of (a) his commanding officer, or the next subordinate officer, if the party is himself the commanding officer, or (b) where the officer, soldier, sailor or airman is serving in military, naval or air force staff employment, the head or other superior officer of the office in which he is employed. Such commanding or other officer shall counter sign the authority, which shall be filed in Court.
(3) When so filed the counter signature shall be sufficient proof that the authority was duly executed, and that the officer, soldier, sailor or airman by whom it was granted could not obtain leave of absence for the purpose of prosecuting or defending the suit in person.
Explanation.—In this Order the expression "commanding officer" means the officer in actual command for the time being of any regiment, corps, ship, detachment or deport to which the officer, soldier, sailor or airman belongs.

(১) যেক্ষেত্রে ওই হিসেবে ²[প্রজাতন্ত্রের] কর্মে প্রকৃতপক্ষে নিয়োজিত কোনো কর্মকর্তা, সৈনিক, নাবিক বা বিমানসেনা কোনো মোকদ্দমার পক্ষ হন, এবং সশরীরে মোকদ্দমা পরিচালনা বা আত্মপক্ষ সমর্থনের উদ্দেশ্যে ছুটি পেতে না পারেন, সেক্ষেত্রে তিনি তাঁর স্থলে মোকদ্দমা করতে বা আত্মপক্ষ সমর্থন করতে যে কোনো ব্যক্তিকে ক্ষমতা দিতে পারবেন।
(২) ক্ষমতা লিখিত হতে হবে এবং কর্মকর্তা, সৈনিক, নাবিক বা বিমানসেনা (ক) তাঁর অধিনায়কের, অথবা পক্ষ নিজেই অধিনায়ক হলে পরবর্তী অধস্তন কর্মকর্তার, অথবা (খ) কর্মকর্তা, সৈনিক, নাবিক বা বিমানসেনা সামরিক, নৌ বা বিমান বাহিনীর স্টাফ পদে কর্মরত থাকলে, তিনি যে দপ্তরে নিয়োজিত সেই দপ্তরের প্রধান বা অন্য কোনো ঊর্ধ্বতন কর্মকর্তার, উপস্থিতিতে তাতে স্বাক্ষর করবেন। উক্ত অধিনায়ক বা অন্য কর্মকর্তা ক্ষমতায় প্রতিস্বাক্ষর করবেন, এবং তা আদালতে দাখিল করতে হবে।
(৩) এভাবে দাখিল করা হলে, প্রতিস্বাক্ষর এই মর্মে পর্যাপ্ত প্রমাণ হবে যে, ক্ষমতাটি যথাযথভাবে সম্পাদিত হয়েছিল, এবং যে কর্মকর্তা, সৈনিক, নাবিক বা বিমানসেনা তা প্রদান করেছেন তিনি সশরীরে মোকদ্দমা পরিচালনা বা আত্মপক্ষ সমর্থনের উদ্দেশ্যে ছুটি পেতে পারেননি।
ব্যাখ্যা।—এই আদেশে “অধিনায়ক” অভিব্যক্তি অর্থ কর্মকর্তা, সৈনিক, নাবিক বা বিমানসেনা যে রেজিমেন্ট, কোর, জাহাজ, ডিটাচমেন্ট বা ডিপো-এর অন্তর্ভুক্ত, আপাতত তার প্রকৃত অধিনায়কত্বে থাকা কর্মকর্তা।
