When any fact is especially within the knowledge of any person, the burden of proving that fact is upon him.
Illustrations
(a) When a person does an act with some intention other than that which the character and circumstances of the act suggest, the burden of proving that intention is upon him.
(b) A is charged with traveling on a railway without a ticket. The burden of proving that he had a ticket is on him.

(ক) যখন কোনো ব্যক্তি কোনো কার্য এমন কোনো অভিপ্রায়ে করেন, যা কার্যটির প্রকৃতি ও পরিস্থিতি থেকে প্রতীয়মান অভিপ্রায় থেকে ভিন্ন, তখন ওই অভিপ্রায় প্রমাণের দায় তাঁর ওপর।
(খ) ক-এর বিরুদ্ধে বিনা টিকিটে রেলপথে ভ্রমণের অভিযোগ আনা হয়েছে। তাঁর টিকিট ছিল মর্মে প্রমাণের দায় তাঁর ওপর।
