এক বছরের মধ্যে একই ধরনের তিনটি অপরাধের অভিযোগ একত্রে আনা যাবেঅনানুষ্ঠানিক অনুবাদ
(1) When a person is accused of more offences than one of the same kind committed within the space of twelve months from the first to the last of such offences, whether in respect of the same person or not, he may be charged with, and tried at one trial for, any number of them not exceeding three.
(2) Offences are of the same kind when they are punishable with the same amount of punishment under the same section of the Penal Code or of any special ²⁹⁰[∗ ∗ ∗] law:
Provided that, for the purpose of this section, an offence punishable under section 379 of the Penal Code shall be deemed to be an offence of the same kind as an offence punishable under section 380 of the said Code, and that an offence punishable under any section of the Penal Code, or of any special or local law, shall be deemed to be an offence of the same kind as an attempt to commit such offence, when such an attempt is an offence.

(১) কোনো ব্যক্তি একই ধরনের একাধিক অপরাধে অভিযুক্ত হলে, যেগুলোর প্রথমটি থেকে শেষটি পর্যন্ত বারো মাসের মধ্যে সংঘটিত হয়েছে, তা একই ব্যক্তির ক্ষেত্রে হোক বা না হোক, তাঁর বিরুদ্ধে সেগুলোর মধ্যে তিনটির বেশি নয় এমন যে কোনো সংখ্যক অপরাধের অভিযোগ আনা যাবে এবং একই বিচারে সেগুলোর বিচার করা যাবে।
(২) দণ্ডবিধির বা কোনো বিশেষ ²⁹⁰[∗ ∗ ∗] আইনের একই ধারার অধীন একই পরিমাণ দণ্ডে দণ্ডনীয় হলে অপরাধসমূহ একই ধরনের হয়:
তবে শর্ত থাকে যে, এই ধারার উদ্দেশ্যে, দণ্ডবিধির ধারা ৩৭৯-এর অধীন দণ্ডনীয় অপরাধ উক্ত দণ্ডবিধির ধারা ৩৮০-এর অধীন দণ্ডনীয় অপরাধের সঙ্গে একই ধরনের অপরাধ বলে গণ্য হবে এবং দণ্ডবিধির বা কোনো বিশেষ বা স্থানীয় আইনের কোনো ধারার অধীন দণ্ডনীয় অপরাধ ওই অপরাধ সংঘটনের উদ্যোগের সঙ্গে একই ধরনের অপরাধ বলে গণ্য হবে, যখন এরূপ উদ্যোগ একটি অপরাধ।
²⁹⁰ “বা স্থানীয়” শব্দগুলো বাংলাদেশ আইন (সংশোধন ও ঘোষণা) আইন, ১৯৭৩ (১৯৭৩ সনের ৮ নং আইন)-এর ধারা ৩ ও দ্বিতীয় তফসিল দ্বারা বিলুপ্ত।
