বিবাদী জামানত সরবরাহ করতে বা নতুন জামানত দিতে ব্যর্থ হলে কার্যপদ্ধতিঅনানুষ্ঠানিক অনুবাদ
Where the defendant fails to comply with any order under rule 2 or rule 3, the Court may commit him to the civil prison until the decision of the suit or, where a decree is passed against the defendant, until the decree has been satisfied:
Provided that no person shall be detained in prison under this rule in any case for a longer period than six months, nor for a longer period than six weeks when the amount or value of the subject-matter of the suit does not exceed fifty Taka:
Provided also that no person shall be detained in prison under this rule after he has complied with such order.

বিবাদী বিধি ২ বা বিধি ৩-এর অধীন কোনো আদেশ পালনে ব্যর্থ হলে, আদালত তাঁকে মোকদ্দমার সিদ্ধান্ত না হওয়া পর্যন্ত, অথবা বিবাদীর বিরুদ্ধে ডিক্রি প্রদান করা হলে ওই ডিক্রি পরিশোধিত না হওয়া পর্যন্ত, দেওয়ানি কারাগারে সোপর্দ করতে পারবে:
তবে শর্ত থাকে যে, এই বিধির অধীন কোনো ব্যক্তিকে কোনো ক্ষেত্রেই ছয় মাসের বেশি সময়, এবং মোকদ্দমার বিষয়বস্তুর পরিমাণ বা মূল্যমান পঞ্চাশ টাকার বেশি না হলে ছয় সপ্তাহের বেশি সময়, কারাগারে আটক রাখা যাবে না:
আরও শর্ত থাকে যে, এই বিধির অধীন কোনো ব্যক্তি ওই আদেশ পালন করার পর তাঁকে কারাগারে আটক রাখা যাবে না।
