জারিঅনানুষ্ঠানিক অনুবাদ
Where persons are sued as partners in the name of their firm, the summons shall be served either—
(a) upon any one or more of the partners, or
(b) at the principal place at which the partnership business is carried on within Bangladesh upon any person having, at the time of service, the control or management of the partnership business there,
as the Court may direct; and such service shall be deemed good service upon the firm so sued, whether all or any of the partners are within or without Bangladesh:
Provided that, in the case of a partnership which has been dissolved to the knowledge of the plaintiff before the institution of the suit, the summons shall be served upon every person within Bangladesh whom it is sought to make liable.

কয়েকজন ব্যক্তির বিরুদ্ধে অংশীদার হিসেবে তাঁদের ফার্মের নামে মোকদ্দমা করা হলে, সমন জারি করতে হবে—
(ক) অংশীদারগণের যে কোনো একজন বা একাধিকজনের ওপর, অথবা
(খ) বাংলাদেশের মধ্যে যে প্রধান স্থানে অংশীদারি ব্যবসা পরিচালিত হয় সেখানে, জারির সময় ওই স্থানে অংশীদারি ব্যবসার নিয়ন্ত্রণ বা ব্যবস্থাপনার দায়িত্বে থাকা যে কোনো ব্যক্তির ওপর,
আদালত যেরূপ নির্দেশ দেয়; এবং অংশীদারগণের সকলে বা কেউ বাংলাদেশের মধ্যে বা বাইরে থাকুন না কেন, এরূপ জারি ওইভাবে যে ফার্মের বিরুদ্ধে মোকদ্দমা করা হয়েছে তার ওপর যথাযথ জারি বলে গণ্য হবে:
তবে শর্ত থাকে যে, মোকদ্দমা দায়েরের আগে বাদীর জ্ঞাতসারে বিলোপ হয়েছে এমন অংশীদারির ক্ষেত্রে, বাংলাদেশের মধ্যে অবস্থানরত এমন প্রত্যেক ব্যক্তির ওপর সমন জারি করতে হবে, যাঁকে দায়ী করার চেষ্টা করা হচ্ছে।
