Description of suit: To enforce payment of money charged upon immoveable property.
Explanation. — For the purposes of this article — (a) the allowances and fees respectively called malikana and haqqs, and (b) the value of any agricultural or other produce the right to receive which is secured by a charge upon immoveable property, and (c) advances secured by mortgage by deposit of title-deeds, shall be deemed to be money charged upon immoveable property.
Period of limitation: Twelve years.
Time from which period begins to run: When the money sued for becomes due.

ব্যাখ্যা।—এই অনুচ্ছেদের উদ্দেশ্যে—(ক) যথাক্রমে মালিকানা ও হক নামে অভিহিত ভাতা ও ফি, এবং (খ) এমন কোনো কৃষিজ বা অন্য ফসলের মূল্য, যা গ্রহণের অধিকার স্থাবর সম্পত্তির ওপর দায় দ্বারা সুরক্ষিত, এবং (গ) স্বত্বদলিল জমাদানের মাধ্যমে বন্ধক দ্বারা সুরক্ষিত অগ্রিম, স্থাবর সম্পত্তির ওপর দায়যুক্ত অর্থ বলে গণ্য হবে।
তামাদির মেয়াদ: বারো বছর।
যে সময় থেকে মেয়াদ গণনা শুরু হয়: যখন যে অর্থের জন্য মোকদ্দমা করা হয়েছে তা পাওনা হয়।
