বিচার ও দন্ড সম্পর্কে রক্ষণ

৩৫। (১) অপরাধের দায়যুক্ত কার্যসংঘটনকালে বলবৎ ছিল, এইরূপ আইন ভঙ্গ করিবার অপরাধ ব্যতীত কোন ব্যক্তিকে দোষী সাব্যস্ত করা যাইবে না এবং অপরাধ-সংঘটনকালে বলবৎ সেই আইনবলে যে দণ্ড দেওয়া যাইতে পারিত, তাঁহাকে তাহার অধিক বা তাহা হইতে ভিন্ন দণ্ড দেওয়া যাইবে না।

(২) এক অপরাধের জন্য কোন ব্যক্তিকে একাধিকবার ফৌজদারীতে সোপর্দ ও দণ্ডিত করা যাইবে না।

(৩) ফৌজদারী অপরাধের দায়ে অভিযুক্ত প্রত্যেক ব্যক্তি আইনের দ্বারা প্রতিষ্ঠিত স্বাধীন ও নিরপেক্ষ আদালত বা ট্রাইব্যুনালে দ্রুত ও প্রকাশ্য বিচারলাভের অধিকারী হইবেন।

(৪) কোন অপরাধের দায়ে অভিযুক্ত ব্যক্তিকে নিজের বিরুদ্ধে সাক্ষ্য দিতে বাধ্য করা যাইবে না।

(৫) কোন ব্যক্তিকে যন্ত্রণা দেওয়া যাইবে না কিংবা নিষ্ঠুর, অমানুষিক বা লাঞ্ছনাকর দণ্ড দেওয়া যাইবে না কিংবা কাহারও সহিত অনুরূপ ব্যবহার করা যাইবে না।

(৬) প্রচলিত আইনে নির্দিষ্ট কোন দণ্ড বা বিচারপদ্ধতি সম্পর্কিত কোন বিধানের প্রয়োগকে এই অনুচ্ছেদের (৩) বা (৫) দফার কোন কিছুই প্রভাবিত করিবে না।

35. (1) No person shall be convicted of any offence except for violation of a law in force at the time of the commission of the act charged as an offence, nor be subjected to a penalty greater than, or different from, that which might have been inflicted under the law in force at the time of the commission of the offence.

(2) No person shall be prosecuted and punished for the same offence more than once.

(3) Every person accused of a criminal offence shall have the right to a speedy and public trial by an independent and impartial Court or tribunal established by law.

(4) No person accused of any offence shall be compelled to be a witness against himself.

(5) No person shall be subjected to torture or to cruel, inhuman, or degrading punishment or treatment.

(6) Nothing in clause (3) or clause (5) shall affect the operation of any existing law which prescribes any punishment or procedure for trial.
